Abstract
In accordance with the Preamble of Organic Law 8/2021 of 4 June on the protection of children and adolescents against violence, the fight against violence against children is a human rights imperative. To promote the rights of children and adolescents enshrined in the Convention on the Rights of the Child, it is essential to ensure and promote respect for their human dignity and physical and psychological integrity by preventing all forms of violence. The protection of minors is a priority obligation of the public authorities, recognised in Article 39 of the Spanish Constitution and in various international treaties, including the Convention on the Rights of the Child, adopted by the United Nations General Assembly on 20 November 1989 and ratified by Spain in 1990. Violence against minors is a sad reality and extended to a plurality of fronts. It can go unnoticed on numerous occasions due to the intimacy of the environments in which it takes place, such as the family and school spheres, environments in which most incidents occur and which, in any case, should be frameworks of security and personal development for children and adolescents. Moreover, sociological, educational, cultural, health, health, economic, administrative and legal variables often converge in these scenarios of violence, which means that any legislative approach to the issue requires a broad multidisciplinary approach. This new law combats violence against children and adolescents from a comprehensive approach, in an extensive response to the multidimensional nature of its risk factors and consequences. From a didactic perspective, it gives essential priority to prevention, socialisation and education, both among minors and among families and civil society itself. The regulation establishes measures for protection, early detection, assistance, reintegration of violated rights and recovery of the victim, which find their inspiration in the comprehensive models of care identified as good practices in preventing secondary victimisation.
